Please read these terms of use ("Terms", "Terms of Use") carefully before using the https://swehosting.se website or any affiliated services ("the Service") operated by ("us", "we", "SweHosting" or "our").

Your access to and use of the Service is conditional upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who use or access the Service.

By accessing or using the Service, you agree to be bound by these Terms, as well as the Acceptable Use Policy and our Privacy Policy. If you do not agree with any part of the Terms, you may not access the Service.

A. Purchases

You represent and warrant that: (i) you have the legal right to use any credit card or other payment method in connection with any purchase; and that (ii) the information you provide to us is true, accurate and complete.
By providing such information, you grant us the right to disclose the information to third parties to facilitate the completion of purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons, including but not limited to: availability of products or services, errors in the description or price of the product or service, errors in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.
We also waive the normal right of refund of 14 days when the order is placed.

B. Account configuration

We process most orders automatically once we and/or our payment processor/partner have screened the order for fraud. It is also your responsibility to provide us with a contact email that does not belong to the domain you purchased from us, or to which your account is linked.
When you create an account with us, you must always provide us with information that is accurate, complete and up-to-date. Failure to do so constitutes a breach of the Terms, which may result in the immediate termination of your account on our Service.
You are responsible for protecting the password you use to access the Service and for any activity or action under your password, whether your password is with our Service or a third party service. You agree not to disclose your password to any third party.
You must notify us immediately when you become aware of any breach of security or unauthorised use of your account.
Website migrations are done as a courtesy, and although they are usually completed on time, more complex migrations can take longer.
You acknowledge that a third party license issued by SweHosting or its affiliates may never be used outside our network unless our written and signed permission is given to do so.
You also acknowledge and agree that use of third-party software requires you to comply with the third-party program's terms of use and other applicable service agreements. Misuse of licensed software may result in account suspension or termination, as well as immediate termination of the software license. We may report misuse of licensed software to applicable third parties. permission is granted to do so.

C. Content

All services provided by SweHosting or its subsidiaries/partners shall only be used for lawful purposes. The applicable law is the law of Sweden.
Any use of the services provided by SweHosting or its subsidiaries/partners that infringes the copyright or trademark of other parties is prohibited. This includes, but is not limited to, distribution of copyrighted material without permission from the author or owner, sale of counterfeit goods, or use of material or data that you do not have the legal right to use.
SweHosting is a hosting provider and shall be used as such. Using a shared host account as a backup or storage for images, files or documents is prohibited and may result in termination of your services.
Storing/streaming large amounts of video or audio from our Services is not permitted and may result in suspension or termination of your Services. This is because streaming such requires a lot of resources, which may negatively affect other customers.
It is prohibited to store software, source code or other material that is illegal or may be used to commit illegal acts. This includes, but is not limited to, software exploits, source code exploits, hacking tutorials or tools, Trojans or other viruses or malware, or instructions on how to create bombs or similar devices.
These breaches (or suspected breaches) are investigated and may result in the termination of your services. Any evidence collected may also be reported to the authorities, depending on the seriousness of the breach - at their discretion.
Game server hosting is allowed on a VPS or dedicated server. However, it is prohibited on hosting platforms. Using our backup services to provide public or private FTP access to content is prohibited. The use of this product is for storing backups, not sharing files. As such, it should only be used to store and retrieve backups between authorized systems.
SweHosting reserves the right to remove any content, without prior warning or notice, that it deems to be insignificant, illegal or threatening - or that violates the Terms of Use in any way, manner or form.
Any material that is considered illegal in Sweden, including - but not limited to - child pornography, bestiality, hate speech or scam sites, will be removed with or without notice and will result in immediate termination of your services.
SweHosting stands for, and fights for, an internet free of fraud and fraudulent content. We believe that the internet is a great source of information and entertainment - and should not be plagued by harmful content. We therefore strictly prohibit all content that is fraudulent. An example of such content might be a website that replicates a brand or known entity of another, and therefore by design deceives a user into believing that the website is real or is connected to that entity even though it is not.

D. Abuse

SweHosting reserves the right to determine what is and is not considered abuse, and while the following serves as a general guideline for what may be considered abusive, it is entirely up to SweHosting and its staff to make a final determination as to whether or not a matter is. falls within the scope of possible abuse. Abuse may include, but is not limited to:

  1. Any attempt to compromise, damage or otherwise cause a degradation in the performance, security or service of electronic devices belonging to SweHosting or any other entity is strictly prohibited. This may include port scanning, vulnerability scanning or IP interval scanning. Any suspected violations will be investigated by our abuse team and may result in the immediate termination of your services.
  2. Denial of Service (DoS/DDoS) attacks directed at us, or any other entity, from our servers or against our servers, are strictly prohibited. Any attempt to launch a DoS/DDoS attack, or a successful attack, will result in the immediate suspension of service and the related logs, along with customer information, will be reported to the authorities.
  3. Incoming DDoS directed at a customer is also defined as abuse under these Terms of Service. SweHosting offers a high level of protection against DDoS attacks directed against our systems and devices thereof. Prolonged, intermittent but frequent or large attacks targeting a specific customer may result in account termination to maintain overall network health.
  4. Staff abuse - being unwilling to help solve your problems, being overly aggressive, condescending or vulgar, will result in suspension or termination of your services. All our staff are here to help and assist you and will not tolerate abusive behaviour.
  5. Any attempt, successful or not, to send spam/solicited email will result in immediate termination of your services. We have an absolute zero tolerance policy for any sending of spam or unsolicited email. We also do not allow email lists, whether legitimate or not. Any site that causes an IP address in our IP space to be blacklisted is also immediately shut down and/or terminated.
  6. Phishing, malware or other similar but equally harmful actions, caused by offering false appearances or misleading visitors.
    The use of traffic exchange services, traffic generators (automated or otherwise) and any application that generates false traffic/requests is prohibited and may result in the suspension of your account.
  7. SweHosting aims to notify customers of abuse within their domain network. Customers are responsible for maintaining communication with the abuse department and taking action as advised. If no response is received within 48 hours of the initial contact, SweHosting reserves the right to immediately terminate the service and delete all data associated with the client.

E. Invoicing

You agree to provide payment for the services received from SweHosting, on the due date for those services. Payment shall be made in full according to the invoice received. You agree that if you have not submitted a cancellation request through the Customer Area, your Services will continue to be billed on a recurring basis.
If you don't pay on time, you'll receive reminder invoices. After one (1) day, your services will be suspended and stop working. A late fee of 20% will also apply at this time, which will be applied on top of your invoice. You understand that this fee must also be paid in order for your services to be reactivated. Once three (3) days have passed since your invoice originally expired, your account will be closed and all files associated with the account will be deleted. Should you wish to reopen the account, this will be done at the current rates. Any old contracts or discounts you have will be void.
Dedicated servers should always be paid before the due date. We will extend a maximum of up to five days, at our discretion, before dismantling the server.
Domain renewal notices are sent five times. 60 days, 30 days, 15 days, 7 days and 1 day before expiry. If you don't pay the invoice, your domains will expire, which may lead to them being purchased by someone else.
We use PayPal and Stripe to process payments. When you pay with PayPal, you have the option to either make a one-time payment or create a billing agreement. A billing agreement (also referred to as a reference transaction or reference payment) means that all of your services, unless cancelled, will be paid on the due date. If there are funds in the PayPal account to cover the purchase, these will be used primarily to make a payment. If the account balance is not sufficient, the primary payment method will be used (e.g. a credit card). If this fails, the backup payment method will be used.
A single billing agreement covers all active services and will be used on all services where it is set as the default payment method in our systems. You understand and agree that by establishing a billing agreement, you are allowing automatic payment of your service invoices and manual payments with your consent. A billing agreement may be cancelled or revoked at any time, either by you as a user via the PayPal website, or by opening a ticket asking you to revoke the billing agreement.

F. Cancellation, refund and termination

If for any reason you (the customer) feel that you are not satisfied with your purchase, or for any other reason wish to cancel it, you can do so by submitting a support ticket via the client area. In the event of a refund, access to your host account will be suspended immediately once the refund is processed, and all files associated with that host account will be permanently deleted. It is therefore recommended that you back up any important files that you may need before requesting a refund.
Refunds are not available unless special circumstances arise. These special circumstances may include (but are not limited to) prolonged downtime, degraded performance, severe lack of support for the service, or pending investigation of fraudulent payment. These are assessed on a case-by-case basis, and the final decision is up to us.
To prevent abuse of this service, the money-back guarantee can only be used once per client. If you (the client) decide to use this clause and then register for a service at a later date, you waive your right to the money-back guarantee.
In the event that the customer has been paying for an extended period of time, the customer may be entitled to an estimated refund. This will be assessed on a case-by-case basis and the decision will be made by SweHosting.
Please note that any costs related to the payment processor, or the cost of completing a transaction with the payment processor or provider, will not be refunded.
Please also note that any misuse of the service or breach of these Terms of Use will invalidate your right to a refund.
Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you can simply stop using the Service by submitting a cancellation request in the Customer Area.
SweHosting reserves the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you violate the Terms.

G. Fraud

SweHosting uses FraudRecord to screen new orders for past fraudulent activity and report existing customers who violate our Terms of Service. In the event of a violation, you may be reported to FraudRecord for misconduct using non-identifiable anonymous information.
We also use MaxMind's order processing services. MaxMind uses several methods to verify the authenticity of an order. In the case of high-risk purchases, you may need to provide a scan of a government-issued ID, and in very rare cases, the credit card used for the purchase. Failure to meet these requirements may mark your order as fraudulent, which may result in it not being processed and reported to FraudRecord as potential fraud (see above).

H. Backups and data loss

Unmanaged OpenVZ/KVM virtual private servers are not backed up by default. The user has the option to purchase a backup add-on to enable full container/virtual machine level backups. These backups are performed, with the backup add-on active, on a weekly basis with four weeks of retention.
Managed OpenVZ/KVM virtual private servers are backed up by default.
Due to the nature of KVM virtualization, the backup process can make the virtual private server offline for a period of time usually no longer than ten minutes when it generates the backup. Potential downtime created by backup generation will not be held against SweHosting or counted towards the service level agreement. OpenVZ servers are not normally restored offline during the backup process. The user can opt out of backups if he or she wishes. The user may also replace any included or purchased backup add-on with an equally priced backup storage option.
SweHosting makes no warranty, expressed or implied, as to the condition, completeness or availability of any backups or data stored on our systems. SweHosting will attempt to provide uninterrupted, timely and secure services (except for scheduled maintenance or other problems beyond SweHosting's reasonable control), but makes no warranty or guarantee to do so. All services are provided on an "as is" and "as available" basis.

I. Use of resources

SweHosting uses CloudLinux to actively monitor and limit resource consumption on hosting platforms. This is done to provide a stable and fast platform for all users and to avoid users degrading the performance of others.
Users must not consume 15% or more of system resources for a period longer than 60 seconds. Users may not run any type of search engine, web indexer or web spider. Users may not use any software that interfaces with IRC or an IRC network. Users may not run any torrent application or tracker.
Use of more than 500,000 inodes on all shared accounts may result in termination of your services. Unless you exceed this number, you will always receive several warnings before taking any action. Please note that a file (an image, an email, etc.) counts as one inode.
Virtual private servers have fully dedicated resources in terms of RAM, disk space and bandwidth. However, CPU core usage, I/O usage and network speed usage are not tightly constrained and therefore follow a fair share policy. We reserve the right to immediately suspend or terminate any server found to be abusing any of these resources. We will usually issue several warnings before taking action - but platform performance and stability is considered the highest priority.
Our backup services use a fair bandwidth and I/O usage policy. Should a user demonstrate what SweHosting considers to be abnormal usage patterns that indicate that service levels may be dropping, SweHosting may agree to contact the user and provide a 48-hour window to resolve the issue. Bandwidth usage shall never exceed three times the plan space purchased in a single month.

J. Uptime guarantee

SweHosting guarantees a 99.9% uptime calculated on a monthly basis. If you discover that your uptime is less than 99.9%, you can get credit for the downtime. The credit is at SweHosting's sole discretion. Each instance of downtime is carefully investigated so that any intermittent problems can be addressed. Please note that third-party monitoring times do not count as evidence of downtime, as they may report downtime due to poor routing or local DNS issues.
On virtual private servers, uptime is heavily controlled by the user and the installed software. Our responsibilities include ensuring that the allocated resources are available, as well as ensuring network connectivity and physical server health. Any downtime caused by software or configuration installed/executed by the end user disqualifies the use of SLA terms.
Backup services are excluded from the standard time guarantee due to the increased level of maintenance required to keep these services afloat. Although the actual availability of these services is typically much higher, the uptime guarantee is reduced to 95%, calculated on a monthly basis.
To request credit for downtime, please open a support request to the billing department, along with any justification or proof of said downtime.

K. Reseller: customer responsibility

Resellers are responsible for providing support to their customers. SweHosting takes no responsibility, nor do we provide support for our resellers' customers. Any support requests that require assistance from SweHosting must be made by the reseller from their own customer account. The reseller also takes responsibility for all data and content stored or transferred under their reseller account. The reseller also takes responsibility for the actions of their customers. SweHosting will hold the Reseller responsible for any actions of its customers that result in a breach of the law or the Terms of Use.

L. Price changes

SweHosting reserves the right to make resources available, as well as change the price listed on swehosting.se or other outlets.

M. Scope of support

As a user of our services, you are fully responsible for the installation and operation of any scripts or applications on your service. We are under no obligation (although we often try) to troubleshoot or provide support related to faulty scripts or applications. You are also responsible for maintaining the security and updates of all installed applications.
On our Managed VPS plans, we provide Core Management. Our definition of Core Management includes initial setup and hardening of the server, as well as reactive support for OS or system configuration issues. We actively monitor the status of your server but do not proactively monitor usage. The end user must notify support for issues requiring assistance.

N. Disclosure for law enforcement

SweHosting may disclose any subscription information to law enforcement authorities without further consent or notice to the subscriber upon lawful request by such authorities. SweHosting will attempt to ensure that the request is lawful and that there is a basis for such request prior to disclosure of such information. However, we will cooperate fully with law enforcement authorities.

O. Limitation of liability

In no event shall SweHosting or its directors, employees, partners, agents, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses arising out of (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of a third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or modification of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been advised of the possibility of such damages if any remedy set forth herein is found to have failed of its essential purpose.

P. Reprimand

Your use of the Service is at your own risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. SweHosting by its affiliates, subsidiaries and its licensors does not warrant that a) the Service will operate uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service will be free of viruses or other harmful components; or d) the results of using the Service will meet your requirements. However, SweHosting strives to maintain a very high standard of our Services. For specific information about our SLA in the event of disruption, please refer to the appropriate sections of these Terms of Service.

Q. Arbitration

By using our services, you accept binding arbitration. If any disputes or claims arise against SweHosting or its affiliates, such disputes will be handled by an arbitrator of your choice. All decisions made by the arbitrator are binding and final. You are also responsible for all costs associated with or related to such arbitration

R. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a major revision is made, we will endeavour to give at least 30 days' notice before any new terms come into effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after these revisions have taken effect, you agree to be bound by the revised terms. If you do not agree to the new terms, stop using the Service.
